In-Home Supportive Services and Personal Care Services

The following table is set out in three columns and ten rows. The first column in each row poses a question. The second column answers that question as to In-Home Supportive Services. The third column answers the question as to Personal Care Services under Medi-Cal.

 

 

In-Home Supportive Services ("residual program")

Welf. & Inst. Code §§12300 et seq.

County pays 35% & State 65% of total cost.

Personal Care Services under Medi-Cal, Welf. & Inst. Code § 14132.95

Federal Medicaid pays 50%. Of remaining 50%, County pays 35% & State 65%.

Who is covered?

Advance Pay people; Persons who do not need personal care services or paramedical services.

SSI beneficiaries; 1619 SSI beneficiaries (people who work even though still disabled); Pickles; Model Nursing Facility Waiver people.

Providers?

Relative Providers defined as parents of minors, spouses.

All other providers including parents of adult children.

Services?

All services including protective supervision.

All services except protective supervision which is covered under residual IHSS program.

Severely/ Nonseverely Impaired?

283 hours per month for severely impaired (needs 20 or more hours/week for personal care, paramedical, and meal preparation); 195 for nonseverely impaired.

Maximum of 283 hours.

 

Time covered?

Time for specific tasks, not blocks of time except for protective supervision.

Time for specific tasks -- i.e., in a 4-hour time period may authorize 1.5 hours for tasks.

Can others supplement pay?

Yes, if given directly to provider

No, but can pay for hours not covered such as time between tasks if pay provider directly.

Spouse Provider?

For nonmedical personal care, paramedical services and, if prevented from working, protective supervision & transportation.

Not covered because spouse provider. Other providers can be paid when spouse not able or available.

Parent Provider?

If parent of a minor is prevented from working full time because of the child's specialized care needs, all services except domestic services and protective supervision needed because of age

Not covered because parent provider. Other providers can be paid when parent not able or available -- such as a grandparent when parent works.
