PAI Policy on Legislation Affecting California
Special Education Complaint,
Monitoring and Accountability Systems

BACKGROUND:

California has recently completed a study to determine what improvements must be made in California’s complaint and monitoring system for special education and to make school systems more accountable for results and outcomes for pupils as well as for failures to implement appropriate programs. California sought to enact legislation to implement the results of its study, but the bill made no progress in the first year of the legislative session (1999).

PRINCIPLES:

The following principles should be honored in any proposed legislation or amendments to legislation.

1.          State law should be amended to implement the beneficial results of California’s complaint, monitoring, and accountability study.

2.          State law should not be amended to implement complaint, monitoring, and accountability reforms unless the proposed legislation contains a sufficient number of the meaningful and substantive recommendations of the study.
